Below are the General Terms and Conditions of Sale for online purchases on the website www.culturediff.org. By definition, the general terms and conditions of sale (TCs) provide customers with information about the terms and conditions of sale of a product or service. These general terms and conditions of sale are agreed between,

on the other hand, any natural or legal person wishing to make a purchase on the website www.culturediff.org, hereinafter referred to as « the customer ».


Article 1. Purpose

These general terms and conditions of sale are intended to define the contractual relationship between the company Culture Diff' and the customer, as well as the conditions applicable to any purchase made via the website www.culturediff.org.

The purchase of a product via this website implies the customer's unreserved acceptance of these general terms and conditions of sale, which the customer acknowledges having read prior to confirming her/his basket. Prior to any transaction, the customer declares that he has full legal capacity to commit to these general terms and conditions of sale.

The company Culture Diff' reserves the right to modify these general terms and conditions of sale at any time in order to take into account any changes to the catalog of products offered for sale on the website www.culturediff.org, any changes to the purchasing process on the website www.culturediff.org, or to comply with any new regulations. In fact, the applicable conditions will be those in effect on the date of the customer's order.


Article 2. Products

The products offered for sale by the company Culture Diff' are listed on the website www.culturediff.org, while stocks last. These include astronomy softwares, printed or digital photographs (available for download), and books on Egyptology in paper or digital format. Culture Diff' reserves the right to modify the nature of the products offered for sale at any time. Each product is presented in detail on the website www.culturediff.org.

The sale of digital products offered on the website www.culturediff.org (astronomy softwares, photographs available for download, Egyptology books in digital format) is intended for any customer with an internet connection.

The sale of physical products offered on the website www.culturediff.org (printed photographs, Egyptology books in paper format) is intended for any customer residing in countries that fully authorize the entry of these products into their territory.


Article 3. Prices

The prices listed on the product pages of the website www.culturediff.org are in euros (€). The company Culture Diff' reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the customer. Unless otherwise stated, the prices indicated do not include delivery costs, which are charged in addition to the price of the products purchased. Delivery costs are calculated based on the total amount of the cart and the address provided by the customer during the payment process.


Article 4. Ordering and payment terms

The company Culture Diff' allows customers to order and pay for its products in several steps, on the secure server of the PayPal system. First, the customer selects the products (s)he wishes to order, adds them to his shopping cart, modifies the quantities of each product and the references if necessary, reads and accepts these general terms and conditions of sale by checking the corresponding checkbox, then confirms her/his shopping cart by clicking on the corresponding button. The customer is then redirected to a page summarizing the contents of her/his shopping cart and inviting her/him to make her/his payment on the secure PayPal system interface. With a single click, a window opens, inviting the customer to securely enter her/his PayPal account credentials or credit card information. Next, the customer enters her/his delivery address and any shipping costs are added to the total amount of her/his order.

If payment is accepted, the order is registered and the contract is definitively formed. Payment by PayPal account or credit card is irrevocable. In the event of fraudulent use of the card, the customer may demand cancellation of the card payment, and the sums paid will then be credited back or refunded. The cardholder is not liable if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of their card. To obtain a refund of the fraudulent debit and any bank charges that the transaction may have incurred, the cardholder must dispute the debit in writing with their bank within 70 days of the transaction, or 120 days if the contract between them provides for this. The amounts debited are refunded by the bank within a maximum of one month after receipt of the written dispute submitted by the cardholder. No fees for the refund of the amounts may be charged to the cardholder.

Confirmation of an order implies acceptance of these general terms and conditions of sale, acknowledgment of full knowledge thereof, and waiver of the right to invoke one's own terms and conditions of purchase. All the data provided and the recorded confirmation will serve as proof of the transaction. If the customer has an email address and has entered it during the payment process, the company Culture Diff' will send her/him confirmation of her/his order by email within a few hours of the transaction being validated, and no later than 24 hours thereafter.

Article 5. Retention of title

The company Culture Diff' retains full and complete ownership of the products sold until the corresponding amount has been paid in full.


Article 6. Availability/Delivery of products

Orders for digital products (astronomy softwares, downloadable photographs, Egyptology books) result in the creation of a customer account by the Culture Diff' company within the Client Area of the website www.culturediff.org. Within 24 hours of the transaction being validated, the login details for this account (username and password) will be sent to the customer at the email address (s)he provided during the payment process. Upon receipt of this information, and for an unlimited period of time, the customer will be able to freely log in to her/his account, access the user interface of the softwares (s)he has purchased, or download the photographs or digital books (s)he has ordered.

Orders for physical products (printed photographs, Egyptology books in paper format) are shipped to the customer at the address indicated on the order form by La Poste via COLISSIMO, a tracked delivery service with no signature required upon delivery. Culture Diff' can provide the customer with the tracking number for their package by email. The customer will receive her/his delivery at the address indicated on the order form by her/his postman. In the event of absence, the customer will receive a delivery notice from her/his postman allowing her/him to collect the products ordered from the nearest post office within a period specified by the postal services.

Once items leave the offices of the company Culture Diff', the risks associated with transport are borne by the customer. The customer is required to check the condition of the package and its contents at the time of delivery and in the presence of the postal service employee or delivery person. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.

If delivery times exceed thirty days from the date on which the order was placed, the sales contract may be terminated and the customer reimbursed.


Article 7. Cancellation

Pursuant to Article L121-20 of the Consumer Code, the customer has a period of fourteen working days from the delivery of her/his order of physical products (printed photographs, paper books) to exercise her/his right of withdrawal and return the product(s) to the headquarters of the company Culture Diff' for exchange or refund without penalty, except for return shipping costs. Digital products (astronomy softwares, photographs available for download, digital Egyptology books) made available to the customer in the Client Area of the www.culturediff.org website are not eligible for refunds once the customer has logged into the Client Area at least once using the login details sent to her/him by email within 24 hours of the online transaction being confirmed.


Article 8. Warranty

All products sold by the company Culture Diff', whether physical goods or digital products, are covered by the legal warranty of conformity and the legal warranty against hidden defects.

In the event of non-conformity of a physical product sold, it may be returned to Culture Diff', which will take it back, exchange it, or refund it. In the event of a malfunction of a digital product sold, it may be refunded to the customer.

Article 9. Liability

The company Culture Diff', in the process of distance selling, is bound only by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, service interruption, or other unintentional problems.


Article 10. Intellectual property

All elements of the www.culturediff.org website are and remain the exclusive intellectual property of the Culture Diff' company. Article 12. Dispute resolution

These general terms and conditions of distance selling are subject to French law. For any disputes or litigation, a consumer mediator whose role is to propose an amicable resolution to the dispute may be called upon. Failing this, the competent court for settling commercial disputes between the company Culture Diff' and the customer shall be the Commercial Court of Toulouse, France.
